DMCA Policy and Procedures
This website is hosted on a U.S.-based platform and, as such, operates in compliance with applicable U.S. laws, including the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512. This policy outlines our procedures for addressing alleged copyright infringement in accordance with the DMCA.
The DMCA provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that any content or material made available on or through our website or services infringes your copyright, you (or your authorized agent) may send us a written notice requesting that the content or material be removed, or access to it be blocked.
All notices of alleged copyright infringement should be sent to our Designated Agent for DMCA Notices at the following email address:
Email: dmca@noodledude.io
Important Note: This email address is exclusively for receiving copyright infringement notices under the DMCA. Notices for other types of content removal, such as those related to non-consensual intimate imagery under the Take It Down Act, should be sent to takedown@noodledude.io. More info can be found in our 2257 Statement.
To be effective, a valid DMCA takedown notice must be a written communication that includes substantially the following information as required by 17 U.S.C. § 512©(3):
- Identification of the Copyrighted Work: A detailed description of the copyrighted work that is the subject of claimed infringement, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the Allegedly Infringing Material: A description of the alleged infringing content and information reasonably sufficient to permit us to locate the content on our website or services (e.g., specific URLs where the content appears).
- Contact Information: Sufficient contact information for you, including your full legal name, mailing address, telephone number, and email address.
- Good Faith Statement: A statement by you that you have a good faith belief that the use of the content in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy and Authority Statement: A statement by you, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
- Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner’s behalf. For electronic notices, typing your full legal name at the end of your email with the required statements may be sufficient as an electronic signature.
Failure to include all of the above information may result in the delay or inability to process your complaint.
Fair Use and Transformative Content
The operators of this website believe that the content hosted on this platform, consisting primarily of edited video clips, is created in a manner that is transformative and falls under the doctrine of fair use as recognized by U.S. copyright law.
It is a strict requirement for all videos uploaded to this website that they consist of only small, necessary sections of original videos and are transformative in nature, adding new expression, meaning, or purpose to the original material. This approach is intended to align with the principles of fair use, which permits the limited use of copyrighted material without permission for purposes such as commentary, criticism, parody, or education.
While we believe that content meeting these requirements is likely protected by fair use, it is important to understand that this protection is ultimately determined by courts based on the specific facts of each case.
